Dr. Julia von Buttlar

 Dr. Julia von Buttlar , LL.M. (Duke) is Deputy Head of the Division dealing with Administrative Offence Proceedings at the BaFin’s Directorate for Securities Supervision. Her practice includes all aspects of securities related delinquency and financial markets regulatory policy involving the new sanctioning regime in EU regulations such as MiFID II and MAR. In 2017 she was responsible for drafting and implementing guidelines on the setting of fines in administrative fines proceedings. She also served a secondment with the U.S. Securities and Exchange Commission. She provides legal advice and assistance as enforcement specialist in the development of the European Securities and Markets Authority’s (ESMA) newly established Enforcement Network. The network seeks to foster more consistent enforcement approaches and sanctions in the EU, and finally to build up increased (and more consistent) protection levels for investors. It´s almost exactly ten years ago that the global financial crisis reached its peak. Digitalisation offers a lot of opportunities. This trend is driven in particular by the availability of large quantities of data – big data – and by the improved opportunities for using this data – artificial intelligence. Cautious regulators and supervisors have to be aware of the risks as well. Neither humans nor algorithms should be able to do whatever they want without oversight by people being personally responsible.

 Julia joined the division in March 2007, after having worked for BaFin’s international division. Admitted to the German and New York Bar as attorney-at-law in 2001 she spent her early career as an attorney at Cleary Gottlieb Steen & Hamilton’s Frankfurt office. She holds a doctorate from the University of Darmstadt (DE). She received her Law degree at the Johannes Gutenberg University Mainz (DE), in addition to her studies in law at the University of Burgundy (FR) and further education in at the Duke University (U.S.). She is a demanded public speaker on the subject of enforcement and compliance. In addition, she is a lecturer at the EBS Law School (DE).Over the years, she added numerous scientific publications in the field of Financial Markets Regulation, including in Just/ Voß/ Ritz/ Becker, Commentary on the Securities Trading Act (1st edition) for monitoring short selling.
